We are a hosting provider

ExpressHost provides virtual private servers (VPS). We do not monitor the content our customers place on their servers. So that we can locate the material, your notice should identify the IP address of the server or the URL where the material is available.

Notice of infringement

A notice must be in writing and include the information required by 17 U.S.C. § 512(c)(3)(A):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed or, if a single notice covers multiple works at a single site, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate it, such as a URL or an IP address.
  4. Information reasonably sufficient to permit us to contact you, such as an address, a telephone number and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right.

How we handle a notice

We respond to notices within 24 hours. We forward a valid notice to the customer and require them to remove the material. If the material is not removed, we suspend the service.

Repeat infringers

If 3 copyright complaints against a customer are confirmed within 30 days, the server is blocked.

Counter-notification

If a customer believes that material was removed or disabled as a result of a mistake or misidentification, they may send a counter-notification to our Designated Agent. It must be in writing and include the information required by 17 U.S.C. § 512(g)(3):

  1. A physical or electronic signature of the customer.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or disabled.
  3. A statement under penalty of perjury that the customer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. The customer’s name, address and telephone number, and a statement that the customer consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if the address is outside the United States, for any judicial district in which the service provider may be found), and will accept service of process from the person who provided the notice of infringement or an agent of such person.

We forward a copy of the counter-notification to the complainant. The material may be restored 10 to 14 business days after we receive the counter-notification, unless our Designated Agent first receives notice from the complainant that they have filed an action seeking a court order (17 U.S.C. § 512(g)(2)(C)).

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
